Appeal Court Sacks Elumelu, Declares LP candidate winner

The Court of Appeal in Abuja has overturned the verdict of the National and State Houses of Assembly Election Tribunal in Asaba, which initially declared Ndudi Elumelu, a member of the Peoples Democratic Party (PDP), as the winner of the February 25 election.

In two separate judgments, the Court of Appeal has now declared Ngozi Okolie, the candidate from the Labour Party (LP), as the rightful winner of this election. This decision comes after the Appeal Court found fault with the tribunal’s ruling, which had previously invalidated Okolie’s election.

Subsequently, the petition submitted by Ndudi Elumelu before the tribunal, which had led to the initial verdict, has been dismissed.

The Court of Appeal supported the petition put forth by Mahmud Magaji, SAN, the lawyer representing the Labour Party. According to the court, Okolie was properly nominated and sponsored by his party, meeting all the constitutional requirements.

Also, the court acknowledged that Okolie had resigned from his position as a Senior Special Assistant (SSA) to the Delta State Government, as stipulated by the constitution.
