After an extensive legal battle, Nollywood producer Zeb Ejiro and actress Anne Njemanze, have agreed to settle their dispute over the trademark for the classic movie “Domitilla” out of court.
In her lawsuit with the number FHC/L/CS/2305/2022, Njemanze accused Ejiro of trademark infringement and sought N50 million in damages, as well as an injunction to prevent the use of her trademark.
In response, Ejiro filed a countersuit for N500 million, alleging that Njemanze had used confidential information she obtained while acting in the movie.
However, the pair is now expected to resolve their dispute over the ownership of the brand outside of court.
The Federal Trademark Registry has scheduled a report of settlement for May 4, and if the parties fail to reach an agreement, the Commercial Law Department of the Federal Ministry of Industry, Trade, and Investment will issue a ruling.
This dispute highlights the importance of protecting intellectual property rights in the entertainment industry. Trademarks are valuable assets that help distinguish products and services in the market and establish brand recognition. Thus, it is essential for individuals and businesses to take steps to protect their trademarks and prevent unauthorized use.
While the outcome of the settlement is yet unknown, it is likely that both parties will need to compromise to reach an agreement.
The result may have implications for the use of trademarks in the Nollywood industry and serve as a precedent for future disputes over intellectual property rights.
