The Deputy Governor of Ondo State, Mr. Aiyedatiwa, has taken a decisive step by filing an appeal against the recent ruling of the Akure High Court regarding his impeachment proceedings. This appeal, filed on October 10, 2023, challenges the decision handed down by the court just four days earlier.
Within the Notice of Appeal submitted to the Akure High Court’s registry, Mr. Aiyedatiwa outlines five distinct grounds for his appeal. Among these grounds is a claim that the presiding judge erred in the application of the law by consolidating the hearing of his amendment request with the Ondo State House of Assembly’s jurisdiction challenge. This, he argues, amounts to a violation of his fundamental right to a fair hearing.
Furthermore, the appeal contests the judge’s determination that this case constitutes an abuse of the court’s processes. Mr. Aiyedatiwa asserts that the circumstances and subjects of the case in Akure differ significantly from those of a separate case in Abuja, and therefore should not be treated as such.
In light of these grounds, the Deputy Governor is seeking the Court of Appeal to set aside the earlier ruling by the Akure High Court, a ruling that had previously been delivered on October 10, 2023. The case originally initiated on September 25, 2023, centers around Mr. Aiyedatiwa’s challenge to his impeachment by the Ondo State House of Assembly.
